Constructive Dismissal
Let’s talk about constructive dismissal! Sometimes, bosses don’t want to actually have to fire you. Maybe they just want to get out of giving you a few more weeks of shifts or actually having to give you termination pay.
So, they might try to push you to resign. Maybe they’ll tell you that they have to transfer you to the Scarborough location when you were hired in Mississauga, giving you a long commute. Maybe they stop calling you in for the shifts they promised you or give you work duties that you didn’t get hired for, like asking you to do a ton of physical labour when you were brought on as a cashier.
Any time an employer makes a significant change to a fundamental part of your contract and you resign in response, in the eyes of the ESA, you were fired by them and you are just as entitled to your termination pay.
