A Generous Tip

Your right to your tips cannot be contracted out even if you’ve agreed in the past. It is a protected employment standard. You can’t agree to give your employer all of your tips in exchange for a higher rate of pay or give up your right to minimum wage in exchange for a higher percentage of your tips. You are owed both your wages AND your tips under the ESA.
